OFFICIAL EVENT TERMS AND CONDITIONS
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE SUBMITTING ANY CONTENT TO THE EVENT. BY SUBMITTING AN ENTRY, YOU (THE "CREATOR" OR "PARTICIPANT") AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
1. DEFINITIONS
"ICCA" refers to the Indie Comic Creators of Aotearoa and its subsidiaries, affiliates, officers, employees, and agents.
"Event" refers to the comics, graphic novels, and manga competition organized by ICCA as described in the official Event Rules.
"Submission" or "Work" refers to any comic, graphic novel, manga, artwork, story, script, concept, characters, or other creative materials submitted by a Participant to the Event.
"Community Standards" refers to the ICCA Community Standards document incorporated herein by reference, as amended from time to time.
2. ELIGIBILITY AND AGREEMENT TO RULES
By participating in the Event, Participants agree to be bound by these Terms and Conditions, the official Event Rules (including any length requirements, formatting specifications, and submission deadlines), and the ICCA Community Standards. ICCA reserves the right to disqualify any Participant who violates these terms or whose conduct is deemed inappropriate or contrary to the spirit of the Event.
3. OWNERSHIP OF SUBMISSIONS
3.1 Creator Ownership.
Participants retain all ownership rights in their Submissions. Nothing in this Agreement shall transfer or assign any copyright, trademark, or other intellectual property rights from the Participant to ICCA. The Work remains the sole property of the Creator.
3.2 No Transfer of Rights.
ICCA does not claim any ownership interest in the characters, stories, settings, or other creative elements contained within any Submission.
4. LICENSE TO ICCA FOR PROMOTIONAL USE
4.1 Grant of Promotional License.
By submitting a Work to the Event, the Creator hereby grants ICCA a non-exclusive, royalty-free, worldwide, perpetual license to reproduce, distribute, and publicly display the Work solely for promotional purposes related to the Event and ICCA's activities.
4.2 Permitted Promotional Uses.
Promotional purposes under this Section include, but are not limited to:
- Displaying the Work on ICCA's website, social media accounts, and marketing materials
- Featuring the Work in exhibition displays, event presentations, or promotional videos
- Including the Work in highlight reels, "winner galleries," or similar compilations
- Using the Work to promote future events or ICCA programs
4.3 No Commercial Exploitation.
ICCA shall not use any Submission for commercial purposes, including but not limited to selling merchandise, licensing to third parties, or incorporating the Work into products or services for sale. Any use beyond promotional purposes requires separate written permission from the Creator.
5. USE OF CREATOR'S NAME AND LIKENESS
5.1 Promotional Use of Name.
The Creator grants ICCA the right to use the Creator's name, username (if applicable), profile image, pseudonym, and/or likeness in connection with authorized promotional uses of the Work.
5.2 Credit and Attribution.
ICCA shall make reasonable efforts to provide credit to the Creator in connection with any use of the Work, typically by identifying the Creator by name in conjunction with the displayed Work.
6. RESTRICTION ON USE OF ARTIFICIAL INTELLIGENCE
6.1 AI Prohibited.
The use of generative artificial intelligence (generative AI) tools is strictly prohibited at any stage of the creative process for Submissions to this Event. This prohibition includes, but is not limited to:
- Using AI tools to generate all or part of a written script, story, or narrative
- Using AI tools to generate all or part of artwork, illustrations, panels, or character designs
- Using AI tools to generate all or part of dialogue, captions, or lettering
- Using AI tools for post-processing, refinement, or enhancement of manually created content
- Submitting content that contains AI-generated elements, even if combined with human-created work
6.2 Definition of Generative AI.
For purposes of this Section, "generative AI" means any artificial intelligence technology that produces text, images, or other content in response to user prompts based on training datasets, including but not limited to tools such as ChatGPT, Midjourney, DALL-E, Stable Diffusion, or similar applications.
6.3 Representation and Warranty.
By submitting a Work, the Creator represents and warrants that the Submission is entirely the original work of the Creator (and any collaborators listed) and was created without the use of generative AI tools in any capacity.
6.4 Verification Rights.
ICCA reserves the right to request documentation, source files, work-in-progress materials, or other evidence demonstrating that the Work was created without AI assistance. Failure to provide satisfactory evidence upon request may result in disqualification.
7. CONTENT STANDARDS AND PG-13 RATING REQUIREMENT
7.1 PG-13 Content Standard.
All Submissions must comply with PG-13 content rating standard, as defined below. The following content is strictly prohibited:
Prohibited Sexual Content:
- Graphic or explicit sexual acts
- Sexual nudity (bare buttocks, breasts, or full-frontal nudity)
- Pornographic or obscene material
- Rape or sexual assault depictions (visual or implied)
Prohibited Violent Content:
- Excessive or gratuitous violence against women
- Excessive or gratuitous violence against children or minors
- Detailed depiction of gunshot, stab wounds, or knife/sword slashes where injury is the focus
- Glorification of domestic violence or intimate partner violence
Prohibited Violations of Community Standards:
- Any content that violates the ICCA Community Standards as set forth at the bottom of this page and in the Welcome & Rules channel of the Discord.
- Harassing, defamatory, or libelous content
- Hate speech or discriminatory content targeting any group or individual
7.2 Permitted Content.
The following are acceptable under PG-13 standards:
- Brief non-sexual nudity (e.g., artistic or non-sexual contexts)
- Reasonable use of harsh sexually derived words
- Violence where injury is not the primary focus or is depicted without graphic detail
- Infrequent drug or alcohol use
7.3 Determination of Compliance.
ICCA shall have sole discretion to determine whether a Submission complies with the PG-13 standard and Community Standards. Submissions determined to violate these standards will be disqualified.
8. COMPLIANCE WITH EVENT RULES
Participants agree to abide by all official Event Rules, which include but are not limited to:
- Length requirements as specified in the Event Rules
- Genre and required elements (if any)
- Formatting and file type specifications
- Submission deadlines and procedures
- Number of submissions permitted per Participant
Failure to comply with any Event Rule may result in disqualification without notice.
9. REPRESENTATIONS AND WARRANTIES
The Creator represents and warrants that:
9.1 The Submission is the Creator's original work and does not infringe upon any third party's copyright, trademark, patent, trade secret, moral rights, or other intellectual property or proprietary rights.
9.2 The Submission does not violate any law or regulation.
9.3 The Submission does not contain any matter that is fraudulent, harassing, libelous, obscene, or a violation of any rights of publicity or privacy.
9.4 The Creator has full power and authority to enter into this Agreement and to grant the rights granted herein.
9.5 No generative AI was used in creating any part of the Submission.
9.6 The Submission complies with the PG-13 content standard and ICCA Community Standards.
10. INDEMNIFICATION
The Creator agrees to indemnify, defend, and hold harmless ICCA, its officers, employees, agents, and affiliates from and against any and all claims, demands, causes of action, debts, or liabilities, including reasonable attorneys' fees, arising out of or related to:
- Any breach of the Creator's representations, warranties, or obligations under this Agreement
- Any claim that the Submission infringes upon third-party intellectual property rights
- Any claim arising from the content of the Submission
11. DISQUALIFICATION
ICCA reserves the right to disqualify any Submission that:
- Violates these Terms and Conditions
- Violates the Event Rules
- Contains AI-generated content
- Contains content that infringes upon or incorporates the intellectual property (IP) of any third party (including but not limited to fan fiction, fan art, unauthorized derivative works, or use of copyrighted characters, settings, or storylines not owned by the Creator)
- Violates the PG-13 or Community Standards content requirements
- Contains viruses, malware, or other harmful code
12. NO CONFIDENTIALITY
Submissions are non-confidential and non-proprietary except as expressly provided in Section 3 (Ownership) and Section 4 (License). ICCA shall not be responsible for protecting any intellectual property rights claimed in Submissions.
13. DISPUTE RESOLUTION
13.1 Binding Arbitration. Any dispute arising out of or relating to these Terms and Conditions or the Event shall be resolved by binding, individual arbitration. The Creator waives the right to participate in a class action lawsuit or class-wide arbitration.
13.2 Governing Law. These Terms and Conditions shall be governed by the laws of New Zealand, without regard to its conflict of laws principles.
14. ENTIRE AGREEMENT
These Terms and Conditions, together with the official Event Rules and the ICCA Community Standards, constitute the entire agreement between the Creator and ICCA concerning the Event and Submissions. They supersede all prior or contemporaneous communications or agreements, whether oral, written, or electronic.
15. MODIFICATION AND TERMINATION
ICCA reserves the right to modify, suspend, or terminate this event or these Terms and Conditions at any time for any reason, with or without notice. Any modifications will be posted on the website and/or Discord.
16. SEVERABILITY
If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
ICCA COMMUNITY STANDARDS
Kindness and respect for others is key! Please treat others as you would like to be treated. If another member asks you to cease doing or saying something, please stop. If you have concerns, contact moderators or admin.
Critiques must be asked for (consent is key!) and all provided critiques must focus on what can be improved - not your feelings or opinions about the worth or validity of a work.
If you feel a work is harmful, please immediately contact admin/moderators.
Personal attacks are not allowed. If you have a problem with a person, please bring it directly to them instead of in the general chats/topics, along with the moderators and/or admin.
Harassment of any form (including bullying, trolling, threatening, abuse verbally or via messages or images, making unwanted and unconsented for advances or any other behavior that makes others feel threatened or unsafe) will not be tolerated.
Hate speech (anything that threatens or attacks a group of people on the basis of gender, sexuality, religion, disability, ethnicities/races) will not be tolerated in any form. We do not consider criticism of groups of people in position of power over others to be hate speech and are pro-Palestine.
Discrimination (excluding others for any reason) is not tolerated.
If you have experienced someone expressing pro-rape, pro-pedophilia, pro-hate, or pro-colonization ideology on this server, please report them to the moderators immediately.
Inappropriate content such as NSFW works, writing, or gratuitously graphic, disgusting, obscene, sexual, or violent content is prohibited in all member communications.
Please endeavor to keep things PG13. Pornography, scenes of rape, or sexualization of or children engaged in sexual activity will result in immediate ban and report to the appropriate authorities if needed.
By participating in the Comic Creator Poutama, participants acknowledge that they have read, understood, and agree to be bound by these Terms and Conditions, the Event Rules, and the ICCA Community Standards.
